SPECIAL SESSION on MEDIATION IN REAL ESTATE & LAND DISPUTES

A SPECIAL SESSION ON MEDIATION IS ORGANIZED DURING THE CONFERENCE

The High Level FIG/WORLD BANK/TCG International Conference in Athens addresses in a special session and a following introductory training course the critical issue of alternative real estate and land dispute resolution and opens a new path for fast, low cost and friendly real estate and land conflict settlement with a view to avoid overloading of courts and long lasting, costly, complex and adversarial judicial procedures for land disputes resolution in Greece and other jurisdictions, where such services are weakly offered.
Guest speakers will present the framework of ADR procedures along with real cases that have been resolved through mediation.

Petros Zourdoumis is an Accredited Mediator by the Ministry of Justice and training organizations in Europe and the U.S.A. in the fields of Civil & Commercial Mediation, Workplace Mediation, International Mediation and Cross-border disputes. He is also a negotiator and his main area of expertise is Online Dispute Resolution. He holds a BA in Economics, an LL.B in English Law and an LL.M in European Management & Employment Law and has served as Scientific Associate to the Greek Parliament, Advisor to Central Government and President & CEO in private corporations. He is Special Advisor to the Local Government, Court of First Instance appointed mediation expert and President of the Board of the Association of Greek Mediators. He is member of the ODR global community, member of the ADR World Professionals, member at the American Institute of Mediation and other European and international ADR/ODR related institutions and has participated as delegate, speaker and member of working groups in online dispute resolution initiatives and world conferences. Mediator, General Manager of Craiova Mediation Center (Romania), mediator for the Compliance Advisor Ombudsman office, the independent recourse mechanism for the International Finance Corporation (World Bank) and Senior Consultant of ADR Center (Italy), Adi has worked in the field of dispute resolution for fifteen years and has provided system development, consultancy, mediation and mediation training services in more than 20 countries. He was honored with the Association for Conflict Resolution International Development Committee's 2009 Outstanding Leadership Award for outstanding contributions to international conflict resolution. He is the Co-chair of the Independent Standards Commission convened by the International Mediation Institute.

Robert W. Foster is a Registered Professional Surveyor and a Registered Professional Engineer (Civil) with over 50 years of experience, having graduated from the University of Vermont in 1955 with a B.S. in Civil Engineering. Mr. Foster has specialized in offering professional consulting services in arbitration, dispute resolution, and litigation involving surveying and civil engineering issues. Although semi-retired he is an active member of the Dispute Resolution Panel of Neutrals of REBA Dispute Resolution, Inc., a subsidiary of the Real Estate Bar Association of Massachusetts. Mr. Foster is a past president of the American Congress on Surveying and Mapping and a past president of the International Federation of Surveyors FIG, a federation of over 100 national professional surveying associations. He has provided professional testimony in litigation involving property disputes, appeals of permit denials, eminent domain proceedings, and professional negligence. He has testified before the United States Congress and the Massachusetts legislature on pending legislation and budgetary matters. Mr. Foster grew up in Burlington, Vermont. Following his graduation from UVM he served for three years in the U.S. Air Force where he completed pilot training. He and his wife, Margot and their three sons relocated to Hopkinton, Massachusetts in 1959; he was employed by Schofield Brothers of Framingham, a consulting engineering company until his (semi)retirement in 1990. He continues to provide limited consulting engineering services primarily in dispute resolution, and writes occasionally for technical publications and local newspapers.

Markku has been working for National Land Survey of Finland since 1978. In the beginning as a practitioner and from 1983 as an engineer (Land Surveyor). After becoming a jurist he worked as a Judge at Land Court and with other Judicial tasks for ten years. Since 2008 as a Deputy Director General for National Land Survey he has been working his main task is preparing legislation. His aim is to control legal issues for National Land Survey in Finland in a proper way.

Conclusions report

A report on the specific session on mediation in real estate and land disputes will follow the presentations and discussions which will take place in the specific session. The report will codify observations, practices, proposals, suggested reforms and initiatives towards a workable legal framework that could broadly expand the use of mediation on the real estate sector and will be advanced to policy makers for further action.
